Back to the States
Our time runs out for S. Baja. The woods back up north
seems beckoning. We leave our camp, the rancho, San Cosme and the Agua
Verde road behind us. Because this rancho-fight strategy is well set into
place, we really don't worry at all about any of this...as we work our
way up the Baja road, across the border, through the 25 or 26 hundred
miles from that frontier crossing to our ramshackle cabin. Not until then
do we send a message to Ernesto that we'd made it home. We were both curious
to hear if the legal attack against our primary antagonist, Saul Trojillo,
had been initiated.
He answered us with this series of E-mails, to my secretary Carolyn, who
relayed these to me:

David and Marcia: Like I told you, we are begginin the heavy trial expenses,
in this
part of the trial I had to travel several times to La Paz, finaly yesterday
May 16, I went to court because our Lawyer told me to do it, yust to beggin
the figth, they (the Lawyer and his Lawyer partner) are going to assist
the future tryal meetings....and I will apear only if necesary....
The firsth court day was a triump for us, because I present my self without
a Lawyer, yust with papers answering the Ejido demand....the Law say that
you need a Lawyer by by your side....this was prepared by our Lawyer to
see the panoramic vieu of the figth....the court posposse the metting
to June 15th....no talking, no nothing....five members of Ejido (Crecencio,
Saul etc.) and their Lawyer from Procuranduria Agraria where ready to
figth and shault (shout)....nothing, the car trip worthed..nothing....I
was prepared for that!!!!....
The sad side of the story....
We have in our expenses account....$2,365.00 m.n.
And I need $28,000 m.n. to have it in our figth account like we agree....to
complete $30,000 m.n....to have it ready for any Lawyer or extra payment....
Our Bank money exchanche today is..$8.65
I need the money to be safe, well protected...and sure....
The Lawyer bugdet is in spanish...easy for you...

May 19th I responded by E-mail, through Carolyn:
Ernesto:
Thanks for the E-mail.
Tuesday or Wed. I'm going to send you another $1,000. U.S. for the fight,
another $125. for Chayo and $350 more for the Quijanos and the straw bale
house. Please ask Chayo to take photos of the casa's progression, an occasionally
send us some.
Please tell Chayo that we are sending some colored shell beads through
Sr. Vineges. He needs to tell me if he needs other things.
I need the correct address for the Procurador Agraria in La Paz. Mail
I've sent there comes back to me undelivered.
Are you able to pull up the Spanish version of the 1st lesson to Chavez?
Carolyn says you should be able to.
What is going on with Alejo's historic trails and Trojillo's fence? In
all of what's going on is our lawyer attacking this situation? I'd also
like to know what Alejo and Chayo have told you about the situation with
Loreto officials?
What are the lawyers from the Procuradoria Agraria dong fighting for the
ejido? I thought the ejido was going to have to get their own lawyer to
fight us. Has there been a change of policy about this?

I have a feeling that I'm missing one of my faxes or E-mails to Ernesto.
I must be. I know that I'd expressed more completely my desires to go
on the offensive, more quickly, and especially in regards to Saul and
his fencing. The stopping of all actions of the ejido, within El Carrizalito
and the surrounding area that Ernesto refers to was backed up with several
signed and sealed documents issued by the office of Sector Agraria, an
arm of the Reforma Agraria. These documents effectively put things on
hold in the area until a final decision is reached by the Tribunal Agraria.
Since this is mostly legal boiler plate I'm not going to plug this web
site further with these two pages.

David: Court day was last week, I was waiting to hear the last results
from our Lawyer....Ejido put a value land Engeenier proving the ejido
land marks of Carrizalito in their favor....we have to answer in two weeks
more having our own value land Engeenier, to prove our own land marks,
our Lawyer contract an Engeenier that is going to do the work and present
it in court....it will cost $10,000 m.n.
We have in our account $16,000 M.N., I will use the $10,000 and we are
going to let $6,000 m.n.
Remember we need to have a full $30,000 m.n. in our account to be sure
and firm....
The figth is just beginning, after all this land mark things, we are going
to demand Reforma Agraria not doing the Plano Definitivo correctly....
If this figth goes in a long term....maybe Ejido people are going to try
and negociate with us....
We have to understand David....we are fightin Ejido, Rrforma Agraria,
Procuraduria Agraria and Tribunal Agrario....everybody is in favor of
Ejido and againts us.

My fax to Ernesto July 13, Ô01
Ernesto:
Last Monday we sent you another $1,500. You should have it by now. And
this should put you at or about your $30,000 peso comfort zone,
Sorry I've been so busy that I haven't responded completly to all things
you've mentioned in your E-mails.
For the information concerning Efren I want to thank Payo, Alejo, Chayo
and you. We already had suspicions that things were not going to go well
with him. Too bad because his family sure wanted this to work, their situation
being somewhat desperate. Our last day passing through Loreto we made
a fare-well stop at their casa, us finding Efren quite drunk. He already
knew of my feelings about working with drunks.
Oh, well...teaching them what we did was a fun experience for us, and
certainly we got to learn a great deal from it. And any money lose was
money we weren't afraid to gamble with, any way. We don't consider it
either time or money wasted.
Again, thanks to all of you for the good information. With Payo I'm willing
to take the word of the chief of police. How could the word get any better?
Chayo's casa must be done! We'd really like a recent photo.
I'm finally finding time now to work on my web page. Keep checking it
occasionally, I think you'll see some changes. David
